Terms of Service

1. Agreement to terms

By accessing or using Bankless Budget ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by Bankless Budget ("we," "us," or "our"). You can contact us at support@banklessbudget.com.

2. Description of the Service

Bankless Budget is an automated expense-tracking tool that reads transaction-notification emails from your Gmail inbox, uses AI to extract spending details, and helps you track expenses against a budget. The Service may also sync your transaction data to a Google Sheets spreadsheet you designate.

The Service does not access your bank accounts, credit card accounts, or any financial institution directly. It only reads emails you have labeled in Gmail.

3. Eligibility

You must be at least 13 years old (or the applicable age of consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

4. Account and authentication

  • You sign in using your Google account. You are responsible for maintaining the security of your Google account.
  • You must provide accurate information when creating your account. We rely on the identity information provided by Google OAuth.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at support@banklessbudget.com if you believe your account has been compromised.

5. Google API usage

The Service accesses your Google account data (Gmail and Google Sheets) through Google's APIs using OAuth 2.0 authorization. By using the Service, you authorize us to access the specific Google data described in our Privacy Policy.

You can revoke the Service's access to your Google account at any time through your Google Account settings or through the Bankless Budget Settings page (in-app disconnect requires canceling any active subscription first — see Section 8). Revoking Google access does not cancel a paid subscription — cancel through the billing portal (Section 8.4) or by deleting your account.

6. AI-powered features

The Service uses Google's Gemini AI to extract transaction details from your emails. You acknowledge and agree that:

  • AI-generated results may be inaccurate. The Service may misidentify transactions, extract incorrect amounts, or miscategorize expenses.
  • You are responsible for reviewing and verifying the accuracy of AI-extracted data before relying on it for financial decisions.
  • Email content from your configured Gmail label is transmitted to Google's Gemini API for processing, subject to Google's Gemini API Terms.

7. Subscription tiers and usage limits

The Service offers multiple subscription tiers (Free, Plus, Pro) with different feature access and usage limits. Key limits include:

  • Free tier: Limited to 100 email-sourced transactions per month and 150 AI processing calls per month. Manual sync only. Manual entries are always unlimited.
  • Plus/Pro tiers: Higher or unlimited transaction and AI processing limits. Pro includes real-time sync via push notifications.
  • Rate limits apply to manual sync operations and forced reprocessing to prevent abuse.

We reserve the right to modify tier features and limits. Material changes to paid tier features will be communicated in advance.

8. Billing, payments, and cancellation

8.1 Payment processing

Payments are processed by Stripe. Checkout and subscription management take place on Stripe-hosted pages; we never receive or store your full payment card details. Stripe's handling of your payment information is governed by Stripe's own terms and privacy policy.

8.2 Subscriptions and automatic renewal

Paid plans (Plus and Pro) are recurring subscriptions billed in advance on a monthly or annual basis at the price shown at checkout. Your subscription renews automatically at the end of each billing period until you cancel. The Free tier requires no payment.

8.3 Plan changes

You can upgrade, downgrade, or switch between monthly and annual billing at any time through the billing portal ("Manage billing" in Settings). Plan changes take effect immediately: the change is applied to your existing subscription and Stripe prorates the difference — crediting the unused portion of your current plan toward your future invoices and charging any balance due. You are never charged for two overlapping subscriptions, and a downgrade applies right away rather than waiting until the end of your billing period.

8.4 Cancellation

You can cancel at any time through the billing portal. Cancellation takes effect at the end of your current billing period: you keep your paid features until that date, and your account then moves to the Free tier. Your data is not deleted when you cancel — Free-tier limits simply apply going forward. Deleting your account cancels any active subscription immediately.

8.5 Refunds and disputes

Except where required by law, payments are non-refundable. Canceling does not entitle you to a refund for the unused portion of a paid period — instead, your paid features remain active until the end of that period (Section 8.4). Mid-cycle plan changes are the exception: when you change plans, Stripe automatically prorates the difference and applies any credit for unused time toward your future invoices (Section 8.3).

If you believe you were charged in error, please contact support@banklessbudget.com before disputing the charge with your bank — we can usually resolve billing issues quickly. Filing a chargeback will result in your subscription being canceled and your account returning to the Free tier.

8.6 Failed payments

If a renewal payment fails, Stripe will retry the charge over a limited period, during which your paid access may continue. If payment cannot be collected, your subscription is canceled and your account moves to the Free tier. Your data is preserved.

8.7 Price changes and taxes

We may change subscription prices. Price changes will be communicated in advance and take effect at your next billing period; if you do not agree, you can cancel before the new price applies. Prices may not include taxes; any taxes we are required to collect will be shown at checkout.

9. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Attempt to bypass rate limits, usage caps, or subscription-tier restrictions through scripting, automation, or any other means
  • Access or attempt to access another user's data or account
  • Interfere with or disrupt the Service's infrastructure or security measures
  • Use the Service to process data that is not your own email content
  • Reverse engineer, decompile, or attempt to extract the source code of the Service (except as permitted by applicable law)

10. Your content and license to us

You own your data. All email content, transaction data, budgets, categories, and settings that you provide — or that the Service extracts on your behalf — ("Your Content") remain yours.

You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Your Content solely as necessary to operate and provide the Service — for example, sending email text to Google's Gemini API for transaction extraction (Section 6) and writing transactions to a Google Sheet you designate. This license ends when Your Content is deleted from the Service, except for the limited anonymized retention described in our Privacy Policy. We do not use Your Content to train AI models, and we do not sell it.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Specifically, we do not warrant that:

  • AI-extracted transaction data will be accurate or complete
  • The Service will be uninterrupted, timely, secure, or error-free
  • The Service will meet your specific requirements or expectations
  • Any data synced to Google Sheets will be preserved if you delete or modify the spreadsheet

Bankless Budget is not a financial advisor, tax preparer, or accounting service. The Service is a convenience tool for personal budgeting. You should not rely on it as the sole source of truth for financial, tax, or legal decisions.

12. Limitation of liability

To the maximum extent permitted by applicable law, Bankless Budget and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory.

Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Bankless Budget and its operators from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) content or data you submit to the Service that you did not have the right to use.

14. Account termination

  • By you: You may delete your account at any time through the Settings page. Deletion permanently removes all your personal and financial data from our systems, subject to our Privacy Policy, and immediately cancels any active subscription (see Section 8.4).
  • By us: We may suspend or terminate your account if you violate these Terms, abuse the Service, or if continued operation of your account poses a risk to the Service or other users. We will make reasonable efforts to notify you before termination except in cases of severe abuse.

15. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where possible, notify you through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law principles.

17. Dispute resolution and arbitration

Please read this section carefully — it affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.

17.1 Informal resolution first

Before filing any claim, you agree to first contact us at support@banklessbudget.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

17.2 Binding arbitration

Any dispute arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in the State of Missouri or, at your election, remotely (by telephone, video conference, or written submissions). The Federal Arbitration Act governs the interpretation and enforcement of this section.

17.3 Exceptions

Either party may (a) bring an individual claim in small claims court instead of arbitration, and (b) seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or to address unauthorized access to the Service.

17.4 Class action waiver

All disputes must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

17.5 Opt-out

You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by emailing support@banklessbudget.com with your name and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.
